ZNC Obtains Acquittal for Construction Company In Case of Unwarranted Application of Overweight Truck Statutes

Attorney Brian Tims recently secured acquittals for our client, a well-respected construction company, after a court trial in the Norwalk Superior Court. The State claimed that the company violated applicable gross and axle weight limitations when transporting soil to a job-site using a Mack dump truck. Our client vehemently denied the charges and insisted on a trial. During the trial, Attorney Tims successfully introduced a key piece of evidence over the State’s strong objection. This evidence helped establish that the construction company was in fact operating the truck in a legal manner. On September 21, 2009, Superior Court Judge Maureen Dennis issued a written verdict of not guilty as to both counts. A slip copy of the opinion can be found here.
