We provide services to
condominium, cooperative and planned community
associations throughout Connecticut. We assist
these clients in both the routine and extraordinary
aspects of governance and administration, including:
- Enforcement of
declarations, bylaws and rules concerning
architectural restrictions, the approval of
tenants and leases, the conduct of owners and
tenants, the collection of maintenance fees,
special assessments and fines (including demand
letters and foreclosure of association liens),
occupancy restrictions, and other use
restrictions;
- Drafting of
amendments to governing documents, including
"opt-ins" to the Common Interest Ownership Act,
and advice as to the proper method for amending
the association’s declaration and bylaws and
obtaining of mortgagee approval;
- Interpretation of
governing documents and applicable law as to
responsibility for repair and replacement
expenses;
- Review and
negotiation of association contracts;
- Representation of
the association in litigation against builders
and subcontractors;
- Representation of
the association in litigation against
association officers for breach of fiduciary
duty (such as for theft of association funds);
- Representation of
the association in municipal zoning and other
land use matters;
- Representation of
the association in class action litigation
brought by dissidents;
- General advice as
to association’s conduct of business (including
transition, tax, corporate formality, insurance
and other questions).
